PERSONAL INFORMATION AND PRIVACY

Please consult our Privacy Policies for a description of our practices with respect to collection, sharing and privacy of your personal information. Both our Website Privacy Policy (covering information we collect through our website) and our general Privacy Policy (covering information we collect offline, such as when you sign up at one of our clubs) are located on our official website. 

CHECK-IN

Every member must individually check in at the front desk on each club visit, various check in options may be given for self check in. If member cannot check in to facility themselves, then an authorized staff must manually check them in.

 

MEMBERSHIP FREEZE POLICY

Feral Fitness will only freeze your membership if you are in good standing, all fees are paid, you are current on all your membership dues, and you provide at least thirty days’ notice. If you have a Commitment Agreement and freeze your membership within the Commitment period, your Commitment period and obligation may not be extended for the amount of time your membership was on freeze. Freezing a membership is ultimately up to the discretion of Feral Fitness. Memberships can be frozen one month at a time and then be reinstated or terminated the following month. Extended freezes for periods of longer than one month are also at the discretion of Feral Fitness, provided good reason from member.  If Feral Fitness does not receive notification to reactivate membership or further extend your freeze within the freeze period, your membership may be reinstated or terminated. No further reoccurring membership dues will be collected during your approved freeze and your right to access Feral Fitness facilities during the freeze will be suspended. Notwithstanding the foregoing, you will still be required to pay all applicable fees and taxes due, as provided in your membership agreement, during your approved freeze so long as your membership is in effect. Certain fees may apply to any freeze of a member’s membership.

 In the event your membership is prepaid, the term of the prepaid membership may not be extended, without further dues, for the same period of the freeze.

GUEST PRIVILEGES

Feral Fitness encourages you to bring friends, relatives and business associates for a guest visit. We recommend that you make an appointment for your guest's visit. A facility tour/orientation may be required before your guest can access the club. Guests must be at least 18 years old, check in at the front desk, complete the guest registration process, and sign a Liability Waiver. A parent or legal guardian may bring a minor aged 12 or up as a guest if the adult member agrees to sign the appropriate release forms. Feral Fitness may restrict the number of guests and times you may bring guests.

BUDDY PASS PRIVILEGES

Feral Fitness may incorporate a Buddy Pass membership program in which one member partakes as the “host” and the other member partakes as the “buddy”. If you have a Buddy Pass as part of your membership, you may designate only one (1) individual as your buddy to accompany you in the facility.  You may designate a new buddy once every six (6) months and buddy must be a current member. You as the host member must always be present for your buddy to access the club. Your buddy must be at least 18 years old (12 years old with a parent or guardian), complete the member registration process and sign a Liability Waiver. Buddies must check in at the front desk with their host each time prior to accessing the club. Minors wishing to use Feral Fitness facilities on a Buddy Pass membership will be required to have a parent/guardian present during the first visit to register the minor buddy and sign the appropriate release forms. Buddies may not utilize any Feral Fitness facility on a Buddy Pass without their host member being present at all times. If a buddy attempts to enter the facility without their host member or violates club rules, the host’s and buddy’s right to access Feral Fitness ’s facilities may be permanently revoked. Feral Fitness may restrict the times you can bring a buddy.

USE OF Feral Fitness FACILITIES

Availability of Facilities: Feral Fitness facilities or services, including but not limited to, equipment, machinery, classes, sessions, appointments, or any other service may have limited hours, be discontinued altogether at any time, or be offered on a “first come first serve” basis. Feral Fitness reserves the right to charge a separate participation or reservation fee for any or all of these facilities or services. Use of Feral Fitness facilities or services are authorized and limited pursuant to your membership agreement.

Conflicts Regarding Use: Please don't linger on the equipment because other members may want to use it. No member should monopolize the equipment or weights. If there is a sign-up list for the use of the equipment and a maximum time limit on its use, then the directions for the use of the sign-up list are part of the club Rules and Feral Fitness expects all the members to follow them. In short, observe gym etiquette. If there is a conflict over use, let Feral Fitness management resolve it.

Weights & Other Equipment: There may be specific Rules posted regarding the use of the weights and other equipment in Feral Fitness facilities. As a courtesy, please correctly replace all weights/equipment on proper storage rack after you use them and wipe off any benches after your use.

No Solicitation: Feral Fitness facilities are provided for the private use of club members only and are not open to the public. Any solicitation within any club is absolutely forbidden. This includes, for example: solicitation for profit, political purposes or any other reason; use of petitions; distributing or posting leaflets, notices or advertising anywhere in a club facility; or leaving multiple copies of leaflets or other papers in any club.

GENERAL POLICIES FOR MINORS

Please check with the front desk for specific Rules. Parent/guardian and your minor agree to follow all of Feral Fitness Fitness’ Membership Policies and Club Rules. Should you and/or your minor fail to follow any of Feral Fitness’ Policies or Rules, Feral Fitness reserves the right to revoke any permission for you and/or your minor to access its Facilities or otherwise restrict or prohibit access to its Facilities at any time for any or no reason, as determined in Feral Fitness  Fitness’ absolute sole discretion.

Minors 12 - 17: You must be at least 12 years of age to use Feral Fitness facilities. Minors need not be accompanied by a parent or guardian if the minor is a member and their parent or guardian signed all applicable forms required, or if the minor is a guest and the parent or guardian signed the Release of Liability, waiver, or similar forms. Feral Fitness reserves the right, in its discretion, to require that a parent or guardian accompany a minor.

Minors Under 12: You may not use Feral Fitness facilities or be on the workout floor. The applicable minor may wait in lobby area if given permission by Feral Fitness, and such permission can be revoked at any time.

LOCKERS

Feral Fitness may provide lockers for members to use only while working out in the gym. If private locks are permitted, you should always use a lock to protect your property. Do not leave any valuable property in a locker at any time. Feral Fitness is not responsible for any theft of or damage to your property. If you leave a lock on a locker while you're not in the gym, Feral Fitness will consider your property abandoned and has the right to cut off the lock. If you leave your property, Feral Fitness shall have the right to dispose of your property.

PROHIBITED ITEMS AND ACTIVITIES

No Alcohol, Drugs, or Smoking: You cannot engage in any activity at Feral Fitness while under the influence of illegal drugs or alcohol. Feral Fitness does not permit smoking, alcohol, or illegal drugs, including steroids, in any of its facilities.

No Weapons: No weapons of any kind are permitted in Feral Fitness facilities.

Photos/Filming: Taking photos or filming of others is not permitted without their prior knowledge and consent, and under no circumstances is any photography or filming permitted within the restroom or locker room.

Food & Beverages: Feral Fitness reserves the right to limit the consumption of food or beverages.

Personal Training: No member may train another member, with or without compensation. If Feral Fitness determines that such training occurs at a Feral Fitness facility, the trainer and/or trainee may lose their membership.

Outside Equipment: Feral Fitness reserves the right, in its sole discretion, to limit or restrict the use of outside equipment in the club.

DRESS POLICY

Feral Fitness requires you to wear appropriate clothing and footwear while in its facilities such as gym shorts, T-shirts (that cover your chest), undergarments or tights with all apparel, jogging, aerobic and sweat outfits, clothes that have not been torn or altered. Street clothes/shoes and jeans are not appropriate. Being barefoot in any area, excluding restroom or locker room, is prohibited. Feral Fitness recommends closed toed shoes be worn on the general workout floor at all times, and wearing opened toed shoes or socks alone is at your own risk.

TOWEL POLICY

Carrying a workout towel is recommended. Please use the cleaning station supplies to wipe down equipment after use.

CONDUCT

While in Feral Fitness facilities, Feral Fitness does not permit and will not tolerate any inappropriate conduct. Such conduct includes, without limitation, physical violence, using loud, abusive, offensive, insulting, demeaning language, profanity, lewd conduct or any conduct that harasses or is bothersome to members, guests, or Feral Fitness employees. Such inappropriate conduct is determined by Feral Fitness.

Media Acknowledgement

1. Consent to Videotaping, Photos and Filming:

All members hereby grants permission to Feral Fitness to videotape, take photos, film, and record their image, voice, and performance (hereinafter referred to as "the Recordings") for purposes including but not limited to performance reviews, training, promotional materials, and marketing.

2. Use of Recordings:

Feral Fitness is permitted to use, edit, and reproduce the Recordings in any media format, including but not limited to print, online platforms, social media, and broadcast. This includes use in internal communications and public-facing materials.

3. No Compensation:

The Participant understands and agrees that they will not receive any form of compensation, monetary or otherwise, for the Recordings or their use by Feral Fitness.

4. Intellectual Property Rights:

The Participant acknowledges that all rights, titles, and interests in and to the Recordings, including any intellectual property rights, are owned by Feral Fitness. Feral Fitness may use the Recordings indefinitely unless otherwise agreed upon.

Participant’s Acknowledgment:

By becoming a member, the Participant agrees that they have read, understood, and agree to the terms and conditions outlined in this agreement.

 

VIOLATION OF POLICIES OR RULES

If any member or guest violates any of the Policies or Rules, Feral Fitness will ask that person to stop or leave. A member’s violation of any of the Policies or Rules may also cause Feral Fitness, in its sole discretion, to terminate that person’s membership and/or other agreements.

GENERAL PROVISIONS

Proof of Membership

Member may receive one membership card (included with Member’s membership) (the “Membership Card”) from Feral Reps Fitness LLC and must present it to the reception desk personnel each time Member enters a Feral Reps Fitness LLC facility. Lost membership cards will be replaced for a fee of five dollars ($5), which may be adjusted from time to time. The card must be replaced if lost. Member is required to notify Feral Reps Fitness LLC immediately of the loss of his or her Membership Card, and the Membership Card must be replaced by Member. Membership privileges are limited to the person in whose name the membership is issued. Improper use of the membership will result in confiscation of the Membership Card and can result in immediate cancellation of Member’s membership. A Member wishing to use Feral Reps Fitness LLC facilities without his or her Membership Card will be required to provide proof of identity. (e.g. valid driver’s license, etc.)

 

Day Lockers

Lockers may be provided solely for the benefit and convenience of Feral Reps Fitness LLC members. Feral Reps Fitness LLC will remove any articles left in a locker overnight or any prolonged period of time, subject to determination be Feral Reps Fitness LLC. Member must provide his or her own lock and should not leave any valuables in his or her locker.

 

Pets

Pets (not including service animals) are not permitted in or around a Feral Reps Fitness LLC facility.

 

Dress Code

Proper athletic attire is required. Feral Reps Fitness LLC reserves the right to make the final determination in its sole discretion with regard to appropriate attire.

 

Independent Contractors

From time to time, Feral Reps Fitness LLC may make the services of independent contractors available to Member or guests. Feral Reps Fitness LLC does not warrant or guarantee the quality of these services and does not guarantee that these services will remain available to Member or guests for a period of time.

 

Guests

Guests are permitted in Feral Reps Fitness LLC, but only pursuant to such rules, regulations, fees, schedules for guests as then may be in effect. Feral Reps Fitness LLC reserves the right to limit the number of times any one guest can use a Feral Reps Fitness LLC facility and reserves the right to exclude any guest whose use of the facility, in the sole opinion of Feral Reps Fitness LLC, would be detrimental to Feral Reps Fitness LLC or any of its members. All guests must register at the front desk with valid identification.

 

Spotting

Feral Reps Fitness LLC recommends to all Members and to all guests, spotting by another member or Feral Reps Fitness LLC trainer when using any free weights.

 

Change in Membership Information

Member must promptly notify Feral Reps Fitness LLC in writing of any changes in his or her billing information, address or telephone number. Notwithstanding anything else contained herein, all communications from Feral Reps Fitness LLC to Member shall be presumed to have been received by Member within five (5) business days after mailing to Member’s address or email address on file with Feral Reps Fitness LLC at the time of the mailing.

 

Change in Facilities and Operating Hours

As a result of repair, maintenance or special occasions, Feral Reps Fitness LLC may be required to restrict the use or temporarily close one or more Feral Reps Fitness LLC facilities or halt a Feral Reps Fitness LLC activity from time to time. There will be no reduction , suspension, abatement, or apportionment of membership fees or other charges during such time when the above-mentioned occurs. Feral Reps Fitness LLC’s hours of operation may be modified from time to time without prior notice to Member. Feral Reps Fitness LLC reserves the right to change the facility from time to time, to eliminate some facilities and services, to add others, to add, modify and/or eliminate programs, activities, classes or equipment at Feral Reps Fitness LLC sole discretion.

 

Special Events

Feral Reps Fitness LLC may from time to time reserve the use of its facilities for special events, competitions and private functions.

 

Closing of Feral Reps Fitness LLC Facility

It is anticipated that a part of the facility or the entire facility will be temporarily unavailable from time to time while repairs or renovations take place. Management will make every effort to minimize any disruption to members during these periods, and if possible, to schedule any work during off hours or summer months. Feral Reps Fitness LLC may be closed for holidays and may be closed periodically for renovations. Feral Reps Fitness LLC may also offer members the use of other conveniently located Feral Reps Fitness LLC facilities during the period of unavailability.

 

Interruption of Services

In case of a long-term interruption of service (e.g. fire), Feral Reps Fitness LLC reserves the right to: (a) freeze memberships and add the lost time once service resumes; (b) transfer the member to another similar Feral Reps Fitness LLC facility . In the event that an act of God (hurricane, earthquake, national emergency, etc.) causes more than a temporary closing of Feral Reps Fitness LLC facility, Member’s obligations under the Agreement and these Terms and Conditions will be suspended until such time as use of the facility can be resumed. Obligation for contractual dues will otherwise not be affected unless a Feral Reps Fitness LLC facility cannot reopen within one year of the interruption of service.

(3.16) Non-Discrimination. Feral Reps Fitness LLC represents that it will not discriminate against any person because of sex, race, creed, age, color, national origin, sexual orientation, or ancestry in considering applications for memberships. The minimum age for Feral Reps Fitness LLC membership is eighteen (18), unless parental or guardian permission and Feral Reps Fitness LLC consent is given and approved by Feral Reps Fitness LLC at Feral Reps Fitness LLC sole discretion.

 

Group Exercise Policies

Each class may be limited to a set number of participants. Members should not enter a class late without the instructor’s consent. No one will be admitted ten (10) minutes after the scheduled class time. If Member is just starting a group fitness program or has an injury, prenatal conditions or problem that may prevent full participation, please discuss this with the group fitness instructor at least five (5) minutes before class. Proper clothing and footwear must be worn in all group fitness classes. Feral Reps Fitness LLC reserves the right to change the group fitness schedule at any time including the addition or deletion of classes, as well as changes in instructors, class times and length of classes. Feral Reps Fitness LLC reserves the right to change group fitness policies when necessary and require advanced reservations for heavily attended classes. Reservations may be released within five (5) minutes prior to the scheduled class time and Member may enter on a walk-in basis provided there are openings in the class. Member’s attending a class shall, in addition to the Terms and Conditions, follow any rules promulgated by such class’ instructors.

 

Personal Training

In addition to these Terms and Conditions, any and all personal training provided by Feral Reps Fitness LLC shall be pursuant to any additional terms and conditions set forth in a separate personal training contract entered into by a Member and Feral Reps Fitness LLC. Use of personal trainers not approved by Feral Reps Fitness LLC is prohibited at all Feral Reps Fitness LLC facilities. Member may not train other members or guests, conduct business activity or solicit any business at any Feral Reps Fitness LLC facility. Any violation of this policy may result in legal action as well as forfeiture of any remuneration received by a member or guest for such services.

Promotional Offers

All promotional offers, discounts, free trials, waived fees, referral incentives, founding member specials, limited-time pricing, and similar marketing incentives (collectively, “Promotions”) offered by Feral Reps Fitness LLC d/b/a Feral Fitness (“Company”) are subject to the following terms and conditions:

All Promotions are offered for a limited time and/or limited quantity and may be modified, suspended, or terminated at any time at the sole discretion of Company without prior notice. Promotions may be subject to capacity restrictions. Unless expressly stated otherwise in writing, Promotions are valid for new members only. A “new member” is defined as an individual who has not held an active membership or registered an account. Only one (1) Promotion may be applied per person, per membership, at any time. Promotions may not be combined, stacked, layered, substituted, or used in conjunction with any other offer, discount, referral incentive, corporate rate, or special pricing unless expressly authorized in writing by Company. Promotions are non-transferable, non-assignable, and have no cash value. Promotional benefits may not be redeemed for cash, credit, or refund, unless explicitly stated. Promotional benefits apply only after the member has executed a valid membership agreement, provided valid payment authorization, and completed all required enrollment documentation. Unless otherwise stated in writing, promotional periods automatically convert to the standard membership rate then in effect at the conclusion of the promotional term. Member authorizes automatic recurring billing in accordance with the membership agreement. Certain Promotions may require a minimum commitment term. If applicable, cancellation prior to completion of the minimum term may result in forfeiture of promotional benefits, and/or immediate adjustment to the standard membership rate, and/or assessment of any applicable fees as outlined in the membership agreement. Promotional pricing and incentives are conditioned upon the member remaining in good standing. Delinquent payments, chargebacks, returned payments, policy violations, or breach of agreement may result in immediate forfeiture of promotional benefits and reversion to standard rates. Company reserves the right to deny, revoke, or retroactively void any Promotion if it determines, in its sole discretion, that the member engaged in fraud, misrepresentation, abuse of promotional intent, or violation of facility policies. In such event, standard rates and applicable fees may be applied retroactively. Company reserves the right to update or modify promotional terms at any time. Continued participation in membership following any promotional period constitutes acceptance of applicable standard membership terms then in effect.
